AMBOY, Illinois — A northern Illinois man has been arrested in connection with an ATV crash in August that killed a 7-year-old girl from the city of Amboy.

Prosecutors say 34-year-old Brian Dees was arrested Friday after toxicology results came back showing he had heroin and cocaine in his system when he was driving the all-terrain vehicle.

The ATV struck a deer Aug. 3 and went into a ditch.

Dees and two passengers were thrown from the vehicle. One of them, 7-year-old Makenzie Rutherford, died two days later of her injuries.

According to The (Dixon) Telegraph ( ), Lee County State's Attorney Anna Sacco-Miller said Friday she received the toxicology results a week ago.

Charges including aggravated DUI with an accidental death. Dees is jailed, and his bond has yet to be set.
