SALT LAKE CITY — State attorneys are asking a judge to toss out a lawsuit filed against a Utah school district in a teacher sex case.
They say in court documents obtained Tuesday that schools aren't liable when a student is injured in an assault, including sexual abuse.
The teen argues in a lawsuit filed last month that the Davis County School District didn't do enough to protect students from Brianne Altice.
The 35-year-old former English teacher was accused of having sexual relationships with three male students when they were ages 16 and 17.
She pleaded guilty to three counts of sexual abuse in a deal with prosecutors last month.
The Utah Attorney General's office is representing the school district in the case. A judge hasn't ruled on the motion to dismiss.
