COLUMBUS, Ohio — A judge is blocking fired Ohio State band director Jonathan Waters from questioning the university's athletic director and a lawyer with the U.S. Department of Education's civil-rights office.

Waters claims gender discrimination after being fired for ignoring a "sexualized culture" in the band. He says a female Ohio State cheerleading coach in similar circumstances got a second chance before being fired, but he was treated differently because he's male.

The university argues the situations were different.

Judge James Graham ruled Wednesday that Waters can question the fired coach and her supervisor but not the athletic director or a lawyer who helped settle an investigation into Ohio State's handling of sexual-abuse cases shortly after Waters' firing.

Graham says even proof that Waters was scapegoated under that deal wouldn't advance his claim.
