WILKES-BARRE, Pennsylvania — A northeastern Pennsylvania woman's trial in the shooting death of her boyfriend three years ago has been placed on hold while prosecutors appeal a judge's ruling.

Thirty-year-old Jessica Alinsky is charged in Luzerne County in the September 2011 slaying of 34-year-old Matthew Gailie at their Hazle Township home. She has maintained that he shot himself in the face during a dispute.

Prosecutors also allege that Alinsky manipulated evidence to create the appearance that Gailie shot himself. They want to present evidence that she once staged a burglary at her residence and are appealing Judge Tina Polachek Gartley's ruling barring them from doing so.

Alinsky pleaded guilty to third-degree murder in April but withdrew the plea in May. Prosecutors are now seeking a first-degree murder conviction.
