SCRANTON, Pennsylvania — A judge has dismissed all federal charges against a northeastern Pennsylvania attorney accused of having stolen millions of dollars from clients.
U.S. District Judge Robert Mariani dismissed an indictment against 80-year-old Anthony Lupas, ruling he is incompetent to stand trial. The judge ordered his release from a prison hospital in North Carolina.
Federal prosecutors say Lupas's condition has deteriorated and isn't expected to improve, and he cannot assist in his defense. They said in a statement Friday they regret the prosecution can't go forward.
Authorities had alleged that Lupas bilked clients of more than $6 million over 18 years, promising returns of at least 5 percent in what officials describe as a Ponzi scheme.
