ASHEVILLE, North Carolina — Asheville police say no charges will be filed against the driver involved in an accident that killed a 1-year-old boy.

The Asheville Citizen-Times reports (http://avlne.ws/1qLcY3A) Lucious Bernard Sullivan III was struck and killed when a vehicle hit him last Saturday.

According to police, the driver saw several children standing on the left side of the road and began to slow down. Police said as the driver proceeded, the child darted into the street from between two parked cars and into the path of the 2004 Jeep Cherokee.

Sgt. Dave Romick said the child hit the front right corner of the Jeep, causing his left foot to be run over by the front right tire and sending the child onto the pavement, which caused head trauma.
