LAFAYETTE, Indiana — A man who was shoved by a Lafayette police officer and knocked out of his motorized wheelchair has formally agreed to withdraw his lawsuit against the city for an undisclosed amount of money.
The (Lafayette) Journal and Courier (http://on.jconline.com/1LM9x7b ) reports the settlement between 26-year-old Nicholas Kincade and the city of Lafayette was finalized Thursday. A mediator told a judge in May that the two sides had agreed to a settlement.
Kincade had accused Lafayette Police Lt. Tom Davidson of violating his constitution rights and the Americans with Disabilities Act when Davidson hit him during a 2013 confrontation.
The two sides said the settlement isn't an admission of wrongdoing. Davidson and the city deny liability.
Davidson was suspended and demoted to officer following the incident. Police command staff had recommended he be fired.
