CLARKSBURG, West Virginia — Defense lawyers have asked a judge to dismiss charges against a man accused of killing four people in Clarksburg.
The Exponent Telegram (http://bit.ly/1zQy9kH ) reports that a dismissal motion filed by Sidney Muller's lawyers says the indictment is defective.
The indictment alleges that Muller killed the victims in the commission or attempted commission of a drug delivery. The defense says there's no evidence that Muller was involved in dealing drugs.
The 28-year-old Fairmont man is charged with four felony murder counts. He is accused of fatally shooting 29-year-old Todd Russell Amos, 26-year-old Christopher Hart, 70-year-old Fred Swiger and his son, 47-year-old Freddie Swiger on July 26, 2014.
Police say the Swigers were bystanders who were delivering newspapers.
Muller's trial is scheduled in April.
