PORTLAND, Maine — The city of Portland has agreed to pay $10,000 to settle a federal lawsuit brought by a man who said he was injured by a city police officer.

The Portland Press Herald (http://bit.ly/1QhN3L3 ) reports that Eric Lund, of Windham, agreed to dismiss his lawsuit against Officer Eric McCusker in exchange for the one-time payment.

Under terms of the agreement, Lund changed his claim to say he was hurt accidentally, not from excessive force.

Lund initially contended that McCusker broke his rib during an arrest in September 2012 while he was on the ground by kneeing him in the back.

McCusker denied causing any injury and was cleared of wrongdoing after an internal investigation.

McCusker remains on the force.

Lund's lawyer said the settlement was in his client's "best interest."
