High court declines to hear Pennsylvania teacher's appeal on conviction in sex assault case


LANCASTER, Pennsylvania — The state's highest court has declined to hear the appeal of a former central Pennsylvania teacher convicted of having sex with a 15-year-old student.

The Pennsylvania Supreme Court without comment denied 37-year-old Christy Lee Smith's appeal petition last week. Defense attorney Janice Longer declined comment Monday on the decision.

The former McCaskey High School teacher was sentenced to 14 to 30 years after she was convicted in Lancaster County last year of crimes including sex assault and corruption of a minor. She testified that she and the student kissed but didn't have sex.

She had been convicted earlier of charges involving that 15-year-old boy in 2008 and a 17-year-old in 2009. But an appeals court overturned the conviction, saying she should have had separate trials in the two cases.
