Hurricane man pleads guilty in death of 5-month-old son; sentencing set for Aug. 14

WINFIELD, West Virginia — A Hurricane man has pleaded guilty in the death of his 5-month-old son who was found dead in the backseat of his car in Kanawha City last year.

Multiple news sources report 34-year-old Robert Jeremy Smith was charged with first-degree murder in the death of his son, Madden, on Thursday. He also pleaded guilty to murder of a child, failure to render medical aid and child abuse causing death.

Prosecutors says Smith admitted to not getting his son medical attention when he stopped breathing in May 2014. Court documents show Smith realized his son was dead within minutes, but didn't notify anyone for more than 24 hours.

Police say Smith admitted to shaking his son.

Smith is scheduled to be sentenced Aug. 14, and could receive life in prison.
