AKRON, Ohio — An Ohio judge has scheduled a hearing to consider arguments about DNA evidence before deciding whether a former Akron police captain gets a new trial in the 1997 slaying of his ex-wife.
Defense attorneys argue 69-year-old Douglas Prade (PRAYD) is innocent and deserves a new trial because his DNA doesn't match evidence taken from a bite mark on a lab coat worn by Dr. Margo Prade. The discrepancy prompted a now retired Summit county judge to exonerate and release Prade from prison in January 2013. She also said Prade should get a new trial if her order was reversed.
An Ohio appellate court overturned her decision in March 2014 and ended Prade's 14 months of freedom.
Judge Christine Croce (KROH'-chee) on Monday set Prade's hearing date for Nov. 4.
