Man heading to prison in 2013 shooting that killed man, injured brother at family party

SCHENECTADY, New York — An upstate New York man convicted in a 2013 shooting that killed a man and injured the victim's brother is headed to prison.

A judge sentenced Emmanuel Martinez to 65 years to life in prison on Monday.

Prosecutors say Martinez gunned down 24-year-old Jose "Mikey" Torres and wounded his brother, Luis Gomez, during a Labor Day weekend family gathering in late August 2013. Investigators say Martinez was angry over being beaten up earlier in the night and found the victims at a Schenectady party.

His first trial ended in a mistrial because a juror failed to show up repeatedly during deliberations. He was convicted in June during his retrial.
