Raleigh police arrest man in 2009 Halloween death; first trial ended with hung jury

RALEIGH, North Carolina — Police in Raleigh have arrested a man in a 2009 Halloween shooting death.

Police said 49-year-old James Harold Courtney III was arrested Tuesday and charged with murder in the death of 32-year-old James Carol Deberry Jr.

Charges against Courtney and a co-defendant were dismissed in 2010 after a jury was unable to reach a verdict in the death.

It was not clear if Courtney has an attorney on the new charge.

Deberry was found suffering from a gunshot wound in his apartment on Oct. 31, 2009. He later died at a Raleigh hospital.

Police said in a statement that search warrants were obtained last year for cellphone records for Courtney.
