Police: Man attacked K9, damaged cars during pursuit

Police arrested an Indianapolis man Friday after they say he led them on a dangerous car chase and attacked a K9 during his apprehension.

Brian Scott Kirby, 39, was arrested on charges of resisting arrest using a vehicle, reckless driving and interfering or striking a law enforcement animal.

Greenwood police responded to a report that Kirby, who was driving a black GMC, seemed “messed up.” An officer found him in his vehicle in the parking lot of a Greenwood restaurant off U.S. 31. It was nearly 11 p.m., so the restaurant and surrounding businesses were closed, according to a Greenwood Police Department report.

Kirby drove away, and officers attempted to conduct a traffic stop, but Kirby ignored the sirens and instead drove through several parking lots, off an embankment, through two fences at a Greenwood car dealership and damaged a parked vehicle, according to the report.

He continued to flee west, driving through a construction zone on State Road 37. He hit a section of raised concrete, about 12-16 inches taller than the road, which caused him to lose control of his vehicle and hit a parked trailer. The crash resulted in injuries to his face, said Matt Fillenwarth, assistant chief.

During the pursuit, the squad car carrying the canine was totaled and had to be towed from the scene. No officers were injured in the chase, including the K9, Fillenwarth said.

Kirby’s airbags were activated and his car was leaking fluids. Police ordered him to put his hands out the window, but he did not comply. Officers busted out his driver’s side window and asked that he put his hands up again. After he refused a third time, a K9 entered through the front driver’s side window. The dog was used to prevent human officers from being harmed in apprehending the suspect, as visibility was low, Fillenwarth said.

The K9 apprehended Kirby by grabbing his arm with his teeth and dragging him out of the vehicle. Kirby grabbed and twisted the dog by its ear and neck. Officers told Kirby to release the dog but he did not comply initially. After another command, Kirby let go of the K9 and police handcuffed him, according to the report.

Kirby’s speaking was partially unintelligible, but officers said his breath smelled of alcohol and he mentioned Xanax, a narcotic drug.

He was taken by ambulance to IU Health Methodist Hospital in Indianapolis due to injuries he may have sustained during the chase and the belief that he was under the influence of alcohol and narcotics.

He was then taken to the Johnson County jail where is he is being held on $3,200 bond.
