DENVER — A 67-year-old man has been arrested on a charge of first-degree murder stemming from a decades-old slaying in western Colorado.
Rafael Garcia was arrested in Denver on Monday for the July 4, 1989, shooting death of Charles Porter in Palisade. The Denver Post reports (https://goo.gl/DqgOLl ) Garcia was moved to the Mesa County jail, where he is being held without bail.
Garcia was tried in Mexico as a Mexican citizen in 2009 with the cooperation of the Mesa County Sheriff’s Office, but the prosecution was unsuccessful. Mesa County District Attorney Dan Rubinstein says he believes his office has the right to prosecute Garcia in the United States.
According to a 1989 arrest warrant, Garcia shot Porter twice in the head with a rifle or shotgun.
Booking documents do not indicate if he has hired an attorney.
