HARLAN, Ky. — A grand jury in Kentucky has declined to indict any officers in the death of a man who police said was shot while trying to escape custody.

Mark Sawaf was in federal custody after being charged with making and possessing illegal explosive devices. Police say he had gone with authorities to Harlan County to help them search for trail cameras that they say he rigged with explosives.

Authorities said Sawaf tried to escape and grab a weapon before being shot and killed by Capt. Brad Dobrzynski of the Lexington Fire Department.

Friends and relatives of Sawaf told the Lexington Herald-leader they thought police used excessive force.

Trooper Shane Jacobs told media on Monday that a state police investigation found deadly force was justified and the grand jury agreed.
